Terms of Service

Welcome to LaunchMC! This Terms of Service ("Agreement") constitutes a legally binding agreement made between you, whether personally or on behalf of an entity ("you" or "User"), and Deploy2K LLC ("we," "us," or "our"), concerning your access to and use of the LaunchMC service (the "Service").

The Service is provided to you free of charge. By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by this Agreement. If you do not agree with all of these terms, then you are expressly prohibited from using the Service and you must discontinue use immediately.

1. Acceptance of Terms

By accessing and using the LaunchMC Service, you accept and agree to be bound by the terms and provisions of this Agreement. This Agreement applies to all visitors, users, and others who access the Service.

2. Description of Service

LaunchMC provides services including, but not limited to, Minecraft server performance optimization, security enhancements, and DDoS protection. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We reserve the right to modify, suspend, or discontinue the Service or any part thereof at any time, for any reason, with or without notice, and without any liability to you.

3. User Responsibilities

You are responsible for maintaining the confidentiality of your account information, including your password, and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security. You are solely responsible for your conduct and any data, text, files, information, and content you store or transmit through our Service.

4. Prohibited Activities

You agree not to use the Service for any illegal or unauthorized purpose. You shall not, in the use of the Service, violate any laws in your jurisdiction. Prohibited activities include, but are not limited to:

  • Transmitting any worms, viruses, malware, or any code of a destructive or disruptive nature.
  • Infringing on the intellectual property rights of others.
  • Engaging in any activity that is abusive, harassing, defamatory, or obscene.
  • Using the Service to conduct or facilitate any fraudulent activity.
  • Attempting to interfere with, compromise the system integrity or security of, or decipher any transmissions to or from the servers running the Service.

5. DISCLAIMER OF WARRANTIES

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, DEPLOY2K LLC AND ITS AFFILIATES, SUPPLIERS, AND PARTNERS EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

DEPLOY2K LLC MAKES NO WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, ERROR-FREE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS. ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE SERVICE IS DONE AT YOUR OWN DISCRETION AND RISK, AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM, MINECRAFT SERVER, OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF ANY SUCH MATERIAL.

6. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DEPLOY2K LLC, ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (i) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (ii) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (iii) ANY CONTENT OBTAINED FROM THE SERVICE; AND (iv) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

THIS LIMITATION OF LIABILITY APPLIES WHETHER THE ALLEGED LIABILITY IS BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE. AS THE SERVICE IS PROVIDED FREE OF CHARGE, YOU AGREE THAT THE TOTAL AGGREGATE LIABILITY OF DEPLOY2K LLC IN CONNECTION WITH THIS AGREEMENT AND THE SERVICE SHALL NOT EXCEED ZERO DOLLARS ($0.00).

7. Indemnification

You agree to defend, indemnify, and hold harmless Deploy2K LLC and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), arising from your use of and access to the Service, or from your violation of any term of this Agreement.

8. Governing Law and Jurisdiction

This Agreement shall be governed and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the state and federal courts located within Miami-Dade County, Florida to resolve any dispute, claim, or controversy that arises out of this Agreement or your use of the Service.

9. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide what we determine to be reasonable notice of any material changes. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
